The Pivot Protocol Companion — Barefoot Medicine LLC

These Terms of Service ("Terms") are a binding agreement between you and Barefoot Medicine LLC ("Barefoot Medicine," "we," "us"), which operates The Pivot Protocol Companion (the "Service") at companion.barefootmedicinetraining.com.
By purchasing, accessing, or using the Service, you accept these Terms. If you do not accept them, do not purchase or use the Service.
Section 12 contains a binding arbitration agreement and a waiver of your right to participate in a class action. Please read it carefully.
The Service is an educational reference tool. It uses artificial intelligence to search and explain published teaching materials written by Dr. Christian Nix, and to present that material in response to your questions.
The Service retrieves and explains existing published content. It is a way to navigate a body of educational material without reading all of it.
The Service does not provide medical advice, diagnosis, or treatment. Nothing it produces is medical advice, and nothing in it is a substitute for the judgment of a licensed healthcare professional who has examined you.
No practitioner-patient relationship is created. Using the Service does not make you a patient of Dr. Christian Nix, of Barefoot Medicine LLC, or of anyone associated with either. No one reviews your questions, and no one is monitoring your health.
The Service does not diagnose. It does not identify what condition you have. Any discussion of patterns, types, or categories is an explanation of an educational framework, not an assessment of you.
The Service does not give medication advice. It will not tell you to start, stop, change, or reduce any prescription or over-the-counter medication. Never change a medication except in consultation with the physician who prescribed it.
In an emergency, call emergency services. Do not use the Service for urgent or emergency medical questions. If you are experiencing chest pain, difficulty breathing, severe or sudden pain, bleeding, thoughts of harming yourself, or any other urgent symptom, call 911 or your local emergency number immediately.
Always consult your own physician before acting on anything you read in the Service, before changing your diet, and before starting any supplement, herb, or regimen.
The Service generates responses using an AI language model. You should understand what that means:
Responses may be wrong. AI systems can produce output that is inaccurate, incomplete, outdated, or misleading, including output that is stated confidently. This is a known and unavoidable characteristic of the technology.
Responses are not reviewed by a human before you see them. No practitioner checks any answer before it reaches you.
Responses may not reflect current thinking. The underlying materials were written at particular times and are not continuously updated.
Cited sources should be verified. The Service cites the documents an answer drew from. Where an answer matters to you, read the underlying source.
You are responsible for evaluating the accuracy and suitability of anything the Service produces before relying on it.
You must be at least 18 years old to purchase or use the Service. The Service is not directed to children, and we do not knowingly permit anyone under 18 to use it.
The educational materials underlying the Service were not written for, and the Service should not be used as guidance by, anyone who is pregnant or breastfeeding, anyone under 18, or anyone managing cancer, organ disease, Type 1 diabetes, an eating disorder, or another serious medical condition. If any of these apply to you, consult your physician and do not act on the Service's output.
Access is granted per purchase. Your access credential is stored in your browser. Do not share it. Sharing, reselling, or publishing your access credential is a breach of these Terms and we may terminate your access without refund.
"Lifetime access" means access for as long as we continue to operate the Service. It is not a guarantee that the Service will operate for any particular period. See Section 9.
We limit the number of questions that may be submitted in a given period to protect the Service from abuse and runaway cost. These limits are set well above normal individual use.
You agree not to:
— Use the Service to make decisions about another person's medical care.
— Present the Service's output as professional medical advice to anyone.
— Attempt to extract, scrape, bulk-download, or reconstruct the underlying teaching materials.
— Use the Service to train, fine-tune, or evaluate another AI model.
— Share, resell, or publish your access credential.
— Attempt to bypass access controls, rate limits, or security measures.
— Submit another person's personal or health information without their permission.
The teaching materials, the Pivot Protocol framework and method, the PESC framework, and all content underlying the Service are owned by Barefoot Medicine LLC or Dr. Christian Nix and are protected by copyright.
Your purchase grants you a personal, non-exclusive, non-transferable license to use the Service for your own individual reference. It does not transfer ownership of anything, and it does not grant you the right to reproduce or distribute the underlying materials.
We may modify, suspend, or discontinue the Service at any time. If we permanently discontinue the Service within twelve (12) months of your purchase, we will refund your purchase price on a pro-rata basis. After twelve months, no refund is owed on discontinuation.
We may update these Terms. If we make a material change, we will post the updated Terms with a new "Last updated" date. Continued use after that date constitutes acceptance.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE CORRECT OR SUITABLE FOR YOUR CIRCUMSTANCES.
TO THE FULLEST EXTENT PERMITTED BY LAW, BAREFOOT MEDICINE LLC, DR. CHRISTIAN NIX, AND THEIR OFFICERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SERVICE.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by our negligence, where such exclusion is prohibited by law.
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing any claim, you agree to contact us at info@pivotprotocol.com and attempt to resolve the dispute informally for at least sixty (60) days.
Binding arbitration. If we cannot resolve a dispute informally, you and Barefoot Medicine LLC agree that any dispute arising from or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.
Class action waiver. YOU AND BAREFOOT MEDICINE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
Exceptions. Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court to protect intellectual property rights.
Opt out. You may opt out of this arbitration agreement by emailing info@pivotprotocol.com with the subject line "Arbitration Opt-Out" within thirty (30) days of your purchase. Opting out does not affect any other part of these Terms.
You agree to indemnify and hold harmless Barefoot Medicine LLC and Dr. Christian Nix from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Service, your breach of these Terms, or your reliance on the Service's output in a manner inconsistent with Sections 3 and 4.
These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict of laws rules. Subject to Section 12, the courts located in San Juan, Puerto Rico have exclusive jurisdiction.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Service.
